Denver, CO (KUSA) -- In a first of its kind ruling, the Colorado Civil Rights Division sided with the family of a transgender 6-year-old who was denied use of the girl's restroom.

Coy Mathis was born a boy, but has identified as a girl since she was 18 months old. In February her parents filed a complaint with the Colorado Civil Rights Division on her behalf.
They say Fountain-Fort Carson School District 8 told them Coy had to use the boys' bathroom or a staff bathroom instead of the girls' bathroom.

In a ruling issued this month, the Colorado Civil Rights Division sided with Coy and her family.

It's the first ruling in the nation that says transgender students must be allowed to use bathrooms that match the gender they identify with. 9NEWS has not heard back from the school on the decision.

In a previous statement the school said it "acted reasonably and fairly."

Attorneys for the Coy family plan to hold a press conference about the decision on Monday.
