Walnut Cove, NC - Good news for people living at the "Jim Booth's Catfish Pond" in Walnut Cove.

UPDATE: 12:30 pm Monday, October 15, 2012

They told us last night they were being evicted from the Stokes County camp ground and had to be out by today, Monday, October 15th.

 

But minutes ago the current landlord, Greg Willard, told us that no one is being evicted.

Mr. Willard did say the management of the campground is changing hands this week and that he has no idea what the new landlord will do.

But he emphatically re-stated that he is evicting no one.

News 2 has also talked with the new landlord who says there are no plans to evict the residents. 

 

ORIGINAL STORY:

Teresa Mabe and her neighbors are breathing a sigh of relief.

She called News 2 and told us she received a verbal eviction notice and was only given two days to pack up her belonging and leave.

Mabe and her neighbors at the Jim Booth's Catfish Pond in Walnut Cove, thought that by Tuesday, they could both be without usable facilities and homeless.

"I want people to know you can't just take people's money and then put them out on the street with nowhere to go, leave them homeless and it's not just me and my son, there's several other people here," said Mabe.

There was a change in the ownership of the property where Teresa lives.

Saturday, the former landlord's father told her and the other residents they were being evicted and that if they weren't out by tomorrow, their power would be turned off.

Sheriff Mike Marshall says that's neither true, nor legal.

"Once the property is turned over to the new land owner or operator, it will be up to them to do more evictions if they want to remove them then it will be a court process from there. As far as turning the power off, you can't just go in and cut the power off," said Sheriff Mike Marshall, Stokes County.

Sheriff Marshall says if these former land owners disconnected the power, they could be held liable and could face civil charges.

He says it's important for all renters to know and understand their rights.

The only person who can evict a renter is the landowner and in order to evict a tenant, the landowner must obtain a court order.

A landlord has the right to evict their tenants for a variety of reasons like not paying rent but they cannot evict a tenant in retaliation for certain protected actions. That means, Teresa and her neighbors cannot be evicted for calling us and complaining about their situation.

Renters have rights but they also have responsibilities. They are responsible for paying their rent on time, keeping their place safe and clean and not damaging their property.
