Staley, NC-- A boy is dead and NC Highway Patrol said weather played a part in the fatal crash.
Trooper Greg Ingram said the accident happened around 5:40pm Monday on Wright Country Road in Randolph County.
According to the report, Joseph Presnell was driving south on Wright Country Road when he lost control, went off the road, down an embankment and collided with a utility pole.
Three year-old Jackson Presnell was killed in the collision. Ingram said the report states that the child was not in a back booster seat and he was not properly restrained in the vehicle.
It was pouring rain when the crash happened and Ingram said that contributed to the crash.
The driver and boy's father, Joseph Presnell was taken to the hospital for his injuries.
Wednesday, Highway Patrol confirmed to WFMY News 2 they charged the boy's father in his death.
Joseph Presnell is charged with: Driving With Revoked License, Misdemeanor Death by Motor Vehicle and Exceeding a Safe Speed for Conditions.
The collision is still under investigation.
