ASHEBORO, N.C.-- A man is recovering from a gunshot wound to the back after deputies say he was shot by his girlfriend's brother.
Randolph County Sheriff's deputies were dispatched, around 9:00 p.m. Tuesday, to a house on US Highway 64 West in Asheboro where they found Kenneth Gilley with a gunshot wound to his back.
Investigators said Gilley and his girlfriend had been arguing for most of the day and deputies had already responded to the home to assist the girlfriend with retrieving her personal items to leave.
Later that evening, the girlfriend along with her brother returned to the house to get her car.
Gilley allegedly came outside and confronted the two in the driveway. During the argument, detectives said Robert DeGarmo, the woman's brother, reached into the trunk of his car and pulled out a rifle. DeGarmo allegedly shot Gilley as he ran back to the house.
DeGarmo left the scene after the shooting.
Gilley was treated and released from the hospital, deputies said.
Robert DeGarmo is charged with Attempted Murder and Possession of a Firearm by a Felon. According to detectives, the possession of a Firearm by a Felon charges are for the rifle used during the incident and for a second handgun (owned by DeGarmo) found the night of the incident.
